Terms of Service
Last updated: October 19, 2026
These Terms of Service ("Terms") govern your access to and use of the Sweep software platform at try-sweep.com, the Sweep mobile app, and related services (the "Service"), provided by Sweep Digital Inc. ("Sweep", "we", "us"), a company based in Dartmouth, Nova Scotia, Canada. By creating an account or using the Service, you agree to these Terms on behalf of your business ("you" or the "Customer").
1. The Service
Sweep provides business-management software for service businesses, including scheduling, customer management (CRM), invoicing, quotes, online payments, a business website and booking page, email and SMS messaging, chat, and a staff mobile app. We may update, improve, or change features of the Service over time.
2. Eligibility
The Service is for businesses only and is not offered to consumers for personal, family, or household use. The person creating the account must be at least 18 years old and have the authority to bind the business to these Terms.
3. Accounts
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials, for the team members you invite, and for all activity under your account. Notify us promptly of any unauthorized use.
4. Free trial
New accounts include a 14-day free trial, with no credit card required to start. If you subscribe during the trial, you keep the remaining trial days and your first charge happens when the trial ends. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be suspended, but your data will be retained for a limited period (see section 14) so you can reactivate by subscribing.
5. Subscriptions, fees, and taxes
- The plan costs $99 CAD per month, which includes the account owner's seat.
- Each additional team member ("seat") costs $49 CAD per month, regardless of their role.
- Seats added during a billing period are billed immediately on a prorated basis. Removing a seat takes effect at the start of your next billing cycle, and no refunds are issued for seats removed mid-cycle.
- Prices are in Canadian dollars and exclude applicable taxes (such as GST/HST, PST, or QST), which are added to your invoice where required.
- We may change our prices by giving you at least 30 days' notice by email. The new price applies from your next billing period after the notice period ends. If you do not agree, you may cancel before it takes effect.
Launch pricing. The prices above are introductory launch prices. We expect to increase them as the Service grows, and we may change prices, plans, and what each plan includes at any time. Any change to what you pay will only take effect after the notice described above (or any longer notice required by applicable law), and you can always cancel before it applies to you.
Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
6. Automatic renewal and cancellation
Your subscription renews automatically each month until you cancel. You can cancel at any time in Settings → Billing → Manage billing. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable and we do not give refunds or credits for partial periods. Your data remains yours; you may export it before or after cancelling (see section 14).
7. Failed payments
If a payment fails, Stripe will automatically retry it. If we still cannot collect payment, we may suspend access to the Service until the balance is paid. Your data is kept during a suspension and access is restored once payment succeeds.
8. Your content and data
You own all data and content you put into the Service ("Your Content"), including information about your own customers. You grant us a limited licence to host, process, and display Your Content solely to provide the Service to you. We process personal information in Your Content only to provide the Service and in accordance with your instructions, as described in our Privacy Policy. You are responsible for Your Content and for having the necessary rights and consents to collect and use the personal information of your customers. If a security breach affects Your Content, we will notify you without undue delay.
9. Messaging (email and SMS)
You are the sender of every email and SMS message sent through the Service to your customers and contacts, even though the messages are delivered using Sweep's systems. You are solely responsible for those messages and agree to:
- Obtain, record, and keep valid consent before sending commercial messages, as required by Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any other applicable law.
- Honour unsubscribe and opt-out requests (including "STOP" replies to SMS) promptly and in any case within the time the law requires.
- Clearly identify your business in each message and include your mailing address and a working unsubscribe method where required.
- Not send messages that are false, misleading, harassing, or otherwise unlawful.
We may suspend or limit messaging on your account, without prior notice, if we reasonably believe it is being used for spam, abuse, or in breach of law, or if it puts our sending reputation at risk. You will indemnify Sweep for any claims, fines, or penalties arising from messages you send through the Service.
10. Payments from your customers (Stripe Connect)
If you accept card payments from your customers through Sweep, those payments are processed by Stripe through a Stripe Connect account in your business's name. You are the merchant of record for those payments, and by connecting your account you agree to the Stripe Connected Account Agreement (including the Stripe Services Agreement). Sweep is not a party to transactions between you and your customers and is not responsible for refunds, disputes, chargebacks, or fees between you and your customers.
11. Your website and published content
You are responsible for everything you publish on your Sweep website and booking page, including text, prices, service claims, badges (for example "insured" or "licensed"), reviews, photos, and your own legal pages. You confirm that your claims and badges are true, that reviews are genuine, and that you have the rights and any necessary consent to publish the photos, reviews, and other content you use.
12. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Send unsolicited or unlawful messages, or violate anti-spam or telemarketing laws.
- Upload malware or attempt to gain unauthorized access to the Service or other accounts.
- Interfere with or disrupt the integrity or performance of the Service.
- Resell or provide the Service to third parties except as expressly permitted.
We may suspend or terminate accounts that violate these Terms.
13. Third-party services
The Service integrates with third-party providers (such as Stripe, Twilio, Cloudinary, and Google). Your use of those integrations may be subject to their own terms. We are not responsible for third-party services.
14. Termination and your data afterwards
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required for legal or security reasons. Upon termination, your right to use the Service ends. For 30 days after cancellation or termination, we will provide an export of your data on request. We then delete your data within 90 days, except for encrypted backups (which are deleted on their normal cycle, up to 30 days later) and records we are required to keep by law.
15. Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and features may occasionally be unavailable.
16. Confidentiality
Each party will keep the other's non-public business information confidential, use it only to perform under these Terms, and protect it with reasonable care. This does not apply to information that is public, already known to the receiving party, independently developed, or that must be disclosed by law.
17. Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free licence to use them to improve the Service, without any obligation to you.
18. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
19. Limitation of liability
To the maximum extent permitted by law, Sweep will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, even if we were told they were possible. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
20. Indemnification
You agree to indemnify and hold Sweep harmless from claims, damages, fines, and expenses (including reasonable legal fees) arising from Your Content, your website content, messages you send through the Service, transactions with your customers, your use of the Service, or your violation of these Terms or applicable law.
21. Force majeure
Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as natural disasters, power or internet outages, failures of third-party providers, labour disputes, or government action. This does not excuse your obligation to pay fees.
22. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.
23. Governing law and disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. If a dispute arises, both parties will first try in good faith to resolve it by negotiation for 30 days after one party gives written notice of the dispute. If it is not resolved, the courts located in Nova Scotia will have exclusive jurisdiction, subject to any mandatory protections in your jurisdiction. Either party may bring an eligible claim in small claims court instead.
24. General
- Assignment: you may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of all or part of our business.
- Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and Sweep about the Service and replace any prior agreements.
- Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
- Survival: sections that by their nature should continue after termination (including fees owed, messaging responsibility, confidentiality, disclaimers, limitation of liability, indemnification, and governing law) survive.
- Notices: we send notices by email to the account owner's email address. You can send notices to us at support@try-sweep.com.
